A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day of the conclusion of the contract.
To exercise your right of withdrawal, you must inform us (Niklas Kretschel, Probsteier Straße 2a, 22049 Hamburg, Phone: 01741772202, E-Mail: info@niklaskretschel.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send the notification regarding your exercise of the right of withdrawal before the withdrawal period has expired.
The aforementioned withdrawal period applies to the following services:
Commencement of execution & compensation: If you request that the services (including the ordering of required analysis kits from partner laboratories) should begin during the withdrawal period, you shall pay us a reasonable amount. This amount corresponds to the proportion of the services already provided up to the time you inform us of the exercise of the right of withdrawal compared to the total scope of the services provided for in the contract.
Important notice regarding compensation for DNA analyses: We expressly point out that in the case of DNA analyses, the binding order of the analysis kit from our partner laboratory already represents a partial service for which a fee is charged. In the event of a withdrawal after an order has been placed which the Contractor can no longer cancel free of charge, the compensation to be paid shall include at least the full costs of the analysis kit.
Expiry of the right of withdrawal: The right of withdrawal expires prematurely if we have fully provided the service and only began with the execution after you have given your express consent and confirmed your knowledge that you lose your right of withdrawal upon full fulfillment of the contract.
For the delivery of goods (physical DNA test kits), the withdrawal period is 14 days from the day on which you or a third party named by you took possession of the goods.
Exclusion of the right of withdrawal: The right of withdrawal does not exist for contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of additional costs), without delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. In the case of goods, we may refuse reimbursement until we have received the goods back or until you have provided proof that you have returned the goods. You shall bear the direct costs of returning the goods.
